Information for Ontario distributors and retailers on producer obligations for refillable and non-refillable pressurized containers
As of May 17, RPRA has amended its determination of producer obligations for Coleman-branded non-refillable pressurized containers and, therefore, the determination outlined in this article is no longer applicable. For the amended determination, read this article. The determination that Worthington is not the obligated producer of refillable pressurized containers, as outlined in this article, remains the same.
The Resource Productivity and Recovery Authority has completed a review and determined that Worthington Industries (Worthington) is not resident in Canada and therefore is not the obligated producer of refillable pressurized containers under the Hazardous and Special Products (HSP) Regulation. In keeping with the producer hierarchy outlined in the regulation, the obligation falls to the importer resident in Ontario (e.g., the distributors and retailers) that supplies Worthington-branded refillable pressurized containers. These distributors and retailers have producer obligations, such as registering and reporting supply data to RPRA.
Following a separate review, RPRA has determined that Coleman Company, Inc. (Coleman) is the obligated producer for Coleman-branded non-refillable pressurized containers under the HSP Regulation. Ontario distributors and retailers that supply Coleman-branded non-refillable pressurized containers are not required to register or report their supply data to RPRA for Coleman-branded non-refillable pressurized containers.
Ontario distributors and retailers may have producer requirements under the HSP Regulation for other brands of refillable and non-refillable pressurized containers that they supply. For more information on who is a producer under the HSP Regulation, visit RPRA’s HSP producer webpage.
Consistent with RPRA’s risk-based compliance framework, RPRA will work with obligated producers to support their compliance with the requirements under the HSP Regulation.
