Amended information for Ontario distributors and retailers on producer obligations for non-refillable pressurized containers
In April, the Resource Productivity and Recovery Authority completed a review that determined Coleman Company, Inc. (Coleman) as the producer of Coleman-branded non-refillable pressurized containers under the Hazardous and Special Products (HSP) Regulation. Based on new information gained through working with the regulated community and RPRA’s inspection function, RPRA has determined that Coleman is not the obligated producer of Coleman-branded non-refillable pressurized containers.
In keeping with the producer hierarchy outlined in the regulation, the obligation falls to the importer resident in Ontario (e.g., the distributors and retailers) that supplies Coleman-branded non-refillable pressurized containers. These distributors and retailers have producer obligations, such as registering and reporting supply data to RPRA and setting up a collection and management system for the products they supply into Ontario. The determination that Worthington is not the obligated producer of refillable pressurized containers, as communicated in April, remains the same.
