Government finalizes regulation giving RPRA power to issue monetary penalties
The Ontario government has finalized the Administrative Penalties Regulation (O. Reg. 558/22) under the Resource Recovery and Circular Economy Act, 2016 (RRCEA).
The new regulation gives the Resource Productivity and Recovery Authority (the Authority) the power to issue monetary penalties to obligated parties non-compliant with the RRCEA and its associated regulations, effective January 1, 2023.
To ensure transparency and accountability, all administrative penalties issued will be posted to the Authority’s public website. The Authority will also report annually to the Minister and the public on the use of revenue from administrative penalties.
The Authority will publicly consult in 2023 on how administrative penalties collected by the Authority will be used.
