A producer responsibility organization (PRO) is a business established to contract with producers to provide collection, management and administrative services to help producers meet their regulatory obligations under the Hazardous and Special Products (HSP) Regulation, including:

  • Arranging, establishing or operating a collection or management system.
  • Arranging, establishing or operating a promotion and education system.
  • Preparing and submitting reports.

PROs operate in a competitive market and producers can choose the PRO(s) they want to work with. The terms and conditions of each contract with a PRO may vary.

PRO obligations under the HSP Regulation

As of October 1, 2021, HSP producers are individually accountable and financially responsible for collecting and managing their products when consumers discard them. A PRO that has entered into an agreement with a producer is required under the HSP Regulation to satisfy the requirements that apply to the producer and the type of HSP.

A PRO must register with RPRA within 30 days of being retained by an HSP producer.

Performance report

PROs acting on behalf of a producer are required to submit an annual report with the below information from the previous calendar year.

Reports on category A (oil filters and non-pressurized containers) must include the following:

  • A separate report for each type of HSP.
  • The weight of recovered resources accounted for to meet the producer’s management requirements.
  • A description of the activities undertaken by the producer to comply with the promotion and education requirements.
  • The weight of materials processed from that type of HSP that were:
    • Land disposed,
    • Incinerated,
    • Used as a fuel or a fuel supplement, or
    • Stored, stockpiled, used as daily landfill cover or otherwise deposited on land.

Reports on category B (oil containers, antifreeze, pesticides, refillable pressurized containers, solvents, paints and coatings) must include the following:

  • A separate report for each type of HSP.
  • A description of the activities undertaken by the producer to comply with the promotion and education requirements (except for refillable pressurized containers).
  • The weight of materials processed from that type of HSP that were:
    • Land disposed,
    • Incinerated,
    • Used as a fuel or a fuel supplement, or
    • Stored, stockpiled, used as daily landfill cover or otherwise deposited on land.
  • For pesticides only, the name and contact information of each processor or disposal facility.

Reports on category C (mercury containing barometers, thermometers and thermostats) must include the following:

  • A separate report for each type of HSP.
  • A description of the activities undertaken by the producer to comply with the promotion and education requirements.
  • The weight of mercury recovered from that type of HSP.
  • The weight of materials processed from that type of HSP that were
    • Land disposed,
    • Incinerated,
    • Used as a fuel or a fuel supplement, or
    • Stored, stockpiled, used as daily landfill cover or otherwise deposited on land.

Reports on category D (fertilizers) must include the following:

  • A description of the activities undertaken by the producer to comply with the promotion and education requirements.

Note: there are no annual reporting requirements for category E (refillable propane containers).

Performance audit report

In addition to submitting a performance report, PROs are required to submit an audit report for categories A, B and C that shows how they met performance obligations.

RPRA will not require a performance audit report in 2024 due to the ongoing development of the Resource Recovery Performance Audit Procedure. PROs are still required to submit a performance report. Learn more here.

Management system report

PROs acting on behalf of category A and B producers are required to establish and operate a collection and management system and report every hauler, processor or disposal facility that is part of their management system.

Note:

  • As of January 1, 2023, producers, or PROs on their behalf, can rely on HSP processors on the list to meet their management requirements that start in 2023. The list will be updated as required. View the list of HSP processors here.

Collection activity report

PROs are required to update their collection activities for categories A, B and C by July 31, 2024. After July 31, PROs will be required to submit a monthly confirmation in their Registry account that their collection activities are up to date.
