A producer responsibility organization (PRO) is a person retained by a producer for the purpose of carrying out one or more of the following producer regulatory obligations under the Hazardous and Special Products (HSP) Regulation, including:

Arranging for the establishment or operation of collection or management systems (i.e. processing, hauling, reuse or refurbishment services)
Establishing or operating a collection or management system
Implementing a promotion and education program
Preparing and submitting performance reports

PROs operate in a competitive market, and producers can choose the PRO(s) they want to work with. The terms and conditions of each contract with a PRO may vary.

PRO obligations under the HSP Regulation

Producers are individually accountable and financially responsible for collecting and managing their products once consumers discard them. A PRO that has entered into an agreement with a producer is required under the HSP Regulation to satisfy the collection and/or management system requirements that apply to the producer and the type of HSP.

Collection Activity Report

PROs of categories A and B must regularly update their collection activities in the Registry. Collection activities refer to collection sites, events and seasonal events, call-in and other activity types related to material collection systems.

Annual Performance Reporting

Each year, PROs are required to report on their recovery and management activities from the previous calendar year. PROs must report the following information:

Weight of HSP collected
Weight of resources recovered from processing HSP material
A description of their promotion and education activities

Deadline: Performance reporting is due by July 31 of each year.

Performance audit reporting

RPRA is delaying the requirement for producers and PROs to submit a performance audit report in 2026. This decision was made because RPRA is in the process of finalizing its registry procedure for performance audit reporting. HSP producers and PROs (except fertilizers, refillable pressurized containers and refillable propane containers) will be required to submit their first performance audit report at a later time, to be confirmed in consultation with PROs, and in accordance with the finalized procedure.

Collection Activity Report

PROs of categories A and B must regularly update their producer client’s collection activities in the Registry. Collection activities refer to collection sites, events and seasonal events, call-in and other activity types related to material collection systems.

Annual Performance Reporting

Each year, producers are required to ensure that:

at least 85% of the weight of oil filters they supplied into Ontario was recovered through processing
at least 30% of the weight of non-refillable pressurized containers they supplied into Ontario was recovered through processing

Producers, or PROs on their behalf, are required to report the following information annually in the Registry:

Category A (oil filters and non-pressurized containers), Category B (oil containers, antifreeze, pesticides, solvents and paints and coatings) and Category C (mercury containing barometers, thermometers and thermostats)

A separate report for each type of HSP
Weight of HSP collected
Weight of resources recovered from processing HSP material
A description of their promotion and education activities
For pesticides only, the name and contact information of each processor or disposal facility

Category D (fertilizers)

A description of the activities undertaken by the producer to comply with the promotion and education requirements

Category E (refillable propane containers and refillable pressurized containers)

There are no annual performance reporting requirements for producers of category E

Deadline: Performance reporting is due July 31 of each year.

Note: As a PRO, you cannot report HSP supply data on behalf of your producer clients. They will have to log into their Registry account once a year to provide this information and pay the required program fee.
