Government finalizes amendments to Excess Soil Regulation

The Government of Ontario has finalized amendments to O. Reg. 406/19: On-Site and Excess Soil Regulation (Excess Soil Regulation) and the Rules for Soil Management and Excess Soil Quality Standards (Soil Rules).

These amendments, which come into effect January 1, 2023, include removing the reuse planning requirements for some projects and removing the limit on soil storage piles. For more details about the amendments, read the decision notice.

The registration and notice filing requirements that were temporarily paused in April 2022 will also come back into effect on January 1, 2023. These requirements must be completed in RPRA’s Excess Soil Registry. For help with accessing and navigating the registry, visit our Excess Soil Registry training materials webpage.
