Statement from the Registrar: Fifth update on the inspection of battery producers’ compliance with the Batteries Regulation
RPRA’s inspection of management systems for recycling, reusing, and refurbishing used batteries has determined that all producer responsibility organization (PRO) systems are currently compliant with the Batteries Regulation.
On October 27, 2022, RPRA notified all battery producers that their PROs at the time had been using unregistered battery processors to manage batteries in contravention of the Batteries Regulation. The contraventions have now been addressed. Producers contracted with Call2Recycle and all other registered battery PROs can now rely on them to meet their regulatory obligations to establish and operate a used battery management system.
Producers and PROs can only use the following battery processors registered with RPRA to meet their management requirements in 2023:
- Canadian New Energy Materials Corporation
- Cirba Solutions Canada ULC
- Cirba Solutions US LLC
- Evergreen Battery Recycling, LLC
- EVSX
- Laurentide Re-Sources Inc.
- Li-Cycle Corp.
- Raw Materials Company Inc.
- Terrapure Environmental
This list is subject to change. The current list can be found here on RPRA’s website.
It is the responsibility of producers, on their own or through their PROs, to ensure that their used battery collection and management systems remain compliant with the Batteries Regulation on an ongoing basis.
Although it has been determined that battery producer management systems are currently meeting the regulatory requirement to use registered processors, this is separate from the additional requirement on producers, on their own or through their PRO, to have made best efforts to manage a minimum number of batteries from each applicable category during the applicable performance periods from 2020-2022. As stated in the April 14, 2022, Registrar’s Statement, best efforts means that producers are obligated to, acting in good faith, take all reasonable steps to meet the minimum management requirement.
