Statement from the Registrar: First Notices of Intention to issue administrative penalty orders served to Blue Box and Tires producers

Notices of Intention to issue administrative penalty orders have been served to Blue Box and Tires producers noncompliant with any of the following regulatory requirements:

• Section 19 of O. Reg 391/21: BLUE BOX, which requires producers with management requirements to establish and operate a collection system for Blue Box materials across Ontario.
• Section 69 of O. Reg 391/21: BLUE BOX, which requires producers with management requirements to implement a promotion and education program that informs consumers about the collection of Blue Box materials, including what materials are accepted and how they should be prepared for collection.
• Section 50(2) of O. Reg 391/21: BLUE BOX, which requires producers to submit their annual supply report.
• Section 18(2) of O. Reg. 225/18: TIRES, which requires producers to submit their annual supply report.

The notices are for administrative penalty orders that range from $75,000 to $770,000.

RPRA has communicated directly with affected parties and will not be releasing further information about the notices at this time. RPRA will publicly post administrative penalty orders that have been issued to its website, as required under S.51 (1) of the Resource Recovery and Circular Economy Act, 2016.
