Statement from the Registrar: RPRA issues Administrative Penalty Orders to battery producers

On April 28, 2025, RPRA issued Administrative Penalty (AP) Orders totaling $2,781,725.72 to three battery producers for failing to meet their 2023 management requirement for single-use batteries, as required under s. 12(1) of O. Reg. 30/20 (Batteries Regulation) under the Resource Recovery and Circular Economy Act, 2016 (RRCEA).

The three producers that were issued the AP Orders and the associated penalties are:

  • Duracell – $2,302,259.84 capped at $1,000,000*
  • Energizer – $2,253,495.93 capped at $1,000,000*
  • Panasonic – $781,725.72

*Capped at $1,000,000 as per the Administrative Penalties Regulation

The AP Orders require Duracell, Energizer and Panasonic to either pay the full amount to RPRA within 30 days or appeal the order to the Ontario Land Tribunal within 15 days.

The AP Orders have been publicly posted to the Compliance Orders and Administrative Penalties page of RPRA’s website, as required under s. 51 of the RRCEA.

Prior to issuing the AP Orders, on March 10, 2025, RPRA issued Notices of Intention to serve administrative penalties to three battery producers.
