Regulation requiring digital reporting through RPRA’s Hazardous Waste Program Registry finalized

The Ontario government has finalized regulatory amendments that will require generators, carriers, and receivers of industrial hazardous or liquid waste to report information through a digital reporting system currently being built by the Resource Productivity and Recovery Authority (RPRA).

The amendments to Ontario Regulation 347: General – Waste Management under the Environmental Protection Act (EPA) will require obligated parties to report information through RPRA’s Hazardous Waste Program Registry (The Registry) starting January 1, 2023, instead of reporting through the Ministry of the Environment, Conservation and Park’s Hazardous Waste Information Network (HWIN).

Additional changes to O. Reg. 347 include allowing generators of hazardous waste to delegate reporting requirements and changes to annual registration, as well as other clarifying amendments.

The Ontario government also finalized a new Subject Waste Program Regulation under the Resource Recovery and Circular Economy Act, 2016 that will maintain current fee exemptions for certain hazardous waste management activities from Regulation 347 to the new Registry. The regulation also outlines other fee-setting requirements that RPRA must adhere to when establishing its fees related to the reporting of hazardous waste.

About the Hazardous Waste Program Registry

As directed by the Minister of the Environment, Conservation and Parks, RPRA is responsible for:

  • Providing a digital reporting service (the Registry) that enables regulated persons to comply with the information reporting requirements of the Hazardous Waste Program
  • Setting and collecting fees in a transparent and consultative manner
  • Supporting stakeholders who report under the Hazardous Waste Program

The ministry will continue to oversee the Hazardous Waste Program and be responsible for compliance and enforcement activities.

The Registry will replace the current HWIN system and will include an online reporting portal and electronic manifesting solution, including a mobile app. The new digital reporting service will enable generators, carriers, and receivers to go paperless when reporting to RPRA.

RPRA is building the Registry in close collaboration with the ministry, technology partners, and industry stakeholders to meet the needs of businesses, ensure the new system is easy to use and reduce administrative burden. The Registry will also support the ministry to monitor compliance and undertake timely enforcement actions to hold polluters accountable.

The Registry and mobile app are on schedule to launch January 1, 2023. RPRA will be consulting on fees for Hazardous Waste Program Registry users in fall 2022.
