Government consulting on proposed amendments to Excess Soil Regulation

The Government of Ontario is currently consulting on proposed amendments to the Excess Soil Regulation (Ontario Regulation 406/19), which includes removing the reuse planning requirements for some projects and increasing limits on soil storage. View the proposal.

In April 2022, the Ontario government implemented a temporary suspension of registration and notice filing requirements that regulated persons must complete in the Excess Soil Registry. The requirements that were paused will come back into effect on January 1, 2023.

The Excess Soil Registry, operated by RPRA on behalf of the Ministry of the Environment, Conservation and Parks, continues to remain open for users to complete registration and notice filings during the temporary suspension and through the consultation period. Once the consultation has concluded, RPRA will provide further information on any impacts to Registry users.
