Blue Box PRO Initial Report submitted to RPRA by July 1

Blue Box producer responsibility organizations (or PROs) submitted a report outlining how they plan to operate the Blue Box system on behalf of producers to RPRA by the July 1, 2022, deadline, as set out in the amended Blue Box Regulation.

RPRA received the Initial Report from Ryse Solutions Ontario (Ryse) and Circular Materials Ontario (CMO), representing over 66% of the aggregate weight of Blue Box material supplied to consumers in Ontario in 2020. Resource Recovery Alliance (RRA), a third PRO registered with RPRA, who has agreements with producers under the Blue Box Regulation, is not a party to the Initial Report. The Report outlines process by which RRA or other PROs can join the CMO and Ryse system. The report provides the following information:

  • A description of how the PRO will comply with the collection requirements of the regulation, including any agreements between themselves and any other PRO
  • A detailed description of how the PRO will make collected Blue Box materials available for processing, how materials will be processed and the expected location of receiving facilities in Ontario
  • A description of how the PRO will comply with the promotion and education requirements of the regulation

The Blue Box Regulation does not require that CMO and Ryse implement the specific plans and agreements as described in their report, and RPRA cannot require that they do so. Rather,  the report describes how CMO and Ryse plan to operate their Blue Box collection system, including the intended content of private agreements between CMO and Ryse and their producer clients.

The Blue Box Regulation requires all PROs and producers to meet reporting and performance requirements, which includes a requirement to establish and operate a Blue Box collection system for all eligible sources in Ontario as of July 1, 2023. RPRA, as the regulator for the Blue Box Regulation, is responsible for enforcing those regulatory requirements.
