Hazardous and Special Products Haulers, Processors and Disposal Facilities

Haulers (transporters), processors and disposal facilities are often referred to as service providers.

  • An HSP hauler is a person that arranges the transport of HSP used by consumers in Ontario that is destined for processing, reuse, refurbishing or disposal.
  • An HSP processor is a person that processes HSP used by consumers in Ontario for the purpose of resource recovery.
  • An HSP disposal facility means a facility at which pesticides used in Ontario are disposed of.

Under the HSP Regulation, collection site operators are not required to register or report.

 

What are my obligations under the HSP Regulation?

Haulers are required to complete an annual performance report for each HSP material they transport (excluding fertilizers) to provide information about their recovery and management activities in the previous calendar year.

Haulers will need to log into their Registry account annually and report the following information:

  • Total weight and type of HSP picked up
  • HSP dropped off
    • Sent to a processor
    • Sent to a disposal facility

Deadline: HSP performance reporting is due July 31 of each year.

Processors are required to complete an annual performance report for each material they process (excluding fertilizers) to provide information about their recovery and management activities in the previous calendar year.

Processors will need to log into their Registry account annually and report the following information:

  • Weight of HSP received from each hauler
  • Weight of any materials received from outside of Ontario
  • Weight of processed materials
  • Data on disposed processed materials:
    • Weight of materials that were land disposed
    • Weight of materials that were incinerated (excludes material used as fuel or fuel supplement)
    • Weight of materials used as a fuel or a fuel supplement
    • Weight of materials stored, stockpiled, used as daily landfill cover or otherwise deposited on land
    • Weight of processed materials that were sent for processing by a different processor for further processing based on material type and any types of products that were made by the other person from that type of HSP

Pesticide disposal facilities are required to complete an annual performance report to provide information about their disposal activities in the previous calendar year.

Disposal facilities will need to log into their Registry account annually and report the following information:

  • A description of how the pesticides were disposed
  • Total weight of pesticides received from an HSP hauler
  • Total weight of pesticides received from a person other than an HSP hauler
  • Total weight of pesticides that were received from outside of Ontario (if applicable)

Deadline: HSP performance reporting is due July 31 of each year.

As part of annual performance reporting, processors of oil containers, antifreeze, solvents, paints and coatings, and mercury-containing devices are required to submit an annual report that contains a recycling efficiency rate (RER) in accordance with the HSP Verification and Audit Registry Procedure. The report must include RER for each type of material at each of the processor’s facilities.

Effective this year and going forward, the requirement for individual processors to calculate and report on their recycling efficiency rates (RER) for oil filters, refillable pressurized containers and non-refillable pressurized containers has been removed. Learn more.
