From December 16, 2022, to January 16, 2023, RPRA consulted on the cut-off thresholds that determine if a battery or information technology, telecommunication and audio-visual (ITT/AV) equipment producer is small or large.
Beginning in 2023, only large producers are required to submit a Supply Data Verification Report when reporting their supply data to RPRA. Battery and ITT/AV producers were encouraged to submit feedback on the consultation proposal to consultations@rpra.ca by January 16, 2023. RPRA considered all feedback received when updating the Batteries and ITT/AV Supply Data Verification Procedure with the cut-off thresholds. Consultation Outcomes
Based on feedback received and information gathered throughout the consultation period, RPRA made the following decisions:
- RPRA will use minimum management requirements to define small and large battery and ITT/AV producer cut-off thresholds.
- The cut-off thresholds do not apply to producers who did not submit their Supply Data Report and/or sufficient Verification Report to RPRA in 2022.

Background
Under the Batteries and Electrical and Electronic Equipment (EEE) regulations, producers of Batteries and ITT/AV are required to report new supply information each year in order to establish their management requirement for the following year. Supply data for batteries and ITT/AV can only be reported to the Authority by a producer in accordance with the Batteries Verification and Audit Procedure and the EEE Verification and Audit Procedure.
In 2022, RPRA consulted on the principles and methodologies outlined in the Batteries and ITT/AV Supply Data Verification Procedure. Based on feedback received and other information gathered through the consultation period, RPRA posted the final procedure, which incorporated the following decisions:
- All battery and ITT/AV producers were required to submit a one-time supply data verification report in 2022 (the first verification reporting year);
- To consult on two producer categories (i.e., large and small) after receiving 2022 verified supply data from battery and ITT/AV producers; and
- Starting in 2023, only large producers will be required to submit a verification report. Small producers will no longer be required to submit a verification report but will be subject to inspections.
